SKJB Szybkowski Kuźma Jeleń Brzoza-Ostrowska advised PFR Fundusz Inwestycji Samorządowych FIZAN managed by Polski Fundusz Rozwoju S.A. (PFR) on granting financing for the construction of Andersia Silver - the highest skyscraper in #Poznań and at the same time the largest office building in Wielkopolska!

On SKJB's side, the transaction was lead by Agnieszka Kuźma (partner) and Piotr Kuczyński (associate) with the support of Natalia Styś (associate) and Julia Sikorska (junior associate).

SKJB Szybkowski Kuźma Jeleń Brzoza-Ostrowska advised the SPV of Polish Development Fund Group (PFR) on the sale of the property in Poznań located at Królowej Jadwigi Street, on which the oldest Multikino in Poland is located. The facility is to be replaced by a high-end residential building to be developed by Develia.

Congratulations to both parties on the transaction! The transaction on SKJB's side was led by Agnieszka Kuźma and Joanna Kuczyńska!

Another week, another training in SKJB Szybkowski Kuźma Jeleń Brzoza-Ostrowska


This time, we focused on the topic of commissioning of construction facilities, during and after the Covid regulations were in force.

???? During the Covid regulations in force, could the authority treat the submitted application for an occupancy permit as a notification of the completion of construction works?
???? Could an occupancy permit have been issued during the epidemic?
???? What about applications for occupancy permits/notices of completion of construction works considered after the state of epidemic threat in Poland was lifted (i.e. after 1 July 2023)?

Joanna Kuczyńska, a legal advisor from our Law Firm rightly notes that: "Doubts are raised by the possibility of the construction supervision authority treating an application for an occupancy permit submitted during the period of validity of Article 31zy(1) of the Covid Act as a notification of the completion of construction works. There is no provision that would allow such action by the authority. Similarly, consideration of an application filed during the validity of the above-mentioned regulations after 1 July 2023 generates the risk of revocation of the decision. There are divergent rulings of Administrative Courts on this subject, so the possibility of insuring such a (potential) risk in the event of its identification as part of the legal examination of the property remains to be considered."
